Welcome to KwoTit. By signing up for an account, using our platform, embedding our widgets, or otherwise accessing any part of our Services, you agree to be bound by these Terms of Service and our Privacy Policy.
Please read these Terms carefully. They affect your legal rights, including how subscriptions, content ownership, warranties, and liability are handled.
By visiting our website, creating an account, embedding our widgets, or using our platform, you confirm that you have read, understood, and agree to these Terms.
If you are using our Services on behalf of a company, school, organization, or other entity, you confirm that you have the authority to bind that entity to these Terms, and "you" refers to both you and that entity.
If you do not agree to these Terms, you must not access or use our Services. Continued use of our Services after reviewing these Terms means you accept them in full.
We may update or change these Terms at any time for legal, regulatory, business, or security reasons. Updated Terms will be posted on this page with a revised "Last Updated" date.
For active accounts, material changes that significantly affect your rights or obligations will, where reasonably possible, also be communicated to you directly (for example, by email or dashboard notification).
Your continued use of our Services after any changes take effect constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
To use our Services, you must be of legal age to enter into binding contracts in your country of residence, or have the consent of a parent or legal guardian.
When creating an account, you agree to provide accurate, current, and complete information, and to keep that information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must notify us immediately of any unauthorized use of your account or any other security breach. KwoTit will not be liable for any loss or damage arising from your failure to protect your account.
KwoTit is a platform that allows businesses to build, customize, and publish interactive lead forms. Our Services include, but are not limited to:
Descriptions of Services on our website are for general informational purposes and may be updated, modified, or discontinued at any time without prior notice.
We reserve the right to refuse, limit, or cancel any account or service at our discretion, including where we believe it conflicts with these Terms or our ability to deliver quality service.
New users can subscribe to the Starter Plan to use the Services. The Starter Plan provides access to core KwoTit features, subject to applicable usage limits, such as limits on Lead Forms, lead submissions, or other features. Some features are available only on higher-tier plans. Features and usage limits may change from time to time.
The Pro and Lifetime Plans provide access to additional features, higher usage limits, advanced customization options, and other premium functionality. Monthly subscriptions are billed in advance on a recurring basis, while the Lifetime Plan requires a one-time payment and provides access for the lifetime of the product, subject to these Terms.
We may modify the features, usage limits, or pricing of any plan at any time. If the price of a recurring subscription changes, we will provide reasonable notice before the change takes effect. Updated pricing will apply to your next billing cycle. Continued use of the Services after a pricing change constitutes your acceptance of the updated fees.
You may cancel your subscription at any time through your dashboard. Upon cancellation, your account will revert to the expired plan at the end of your current billing period. No refunds will be issued for partial subscription periods. If you cancel while on a paid plan, you will lose access to paid features at the end of your billing cycle.
KwoTit provides embeddable widgets that you can place on your website or share as standalone pages. The appearance and branding of the widget are controlled by you through your dashboard settings (such as brand color, logo, business name, and intro message).
starter Plan: The widget will display "Powered by KwoTit" or KwoTit branding, and you may not remove or obscure this attribution.
Pro & Lifetime Plans: You may remove KwoTit branding from the widget, and the widget will display only your business name, logo, and brand colors.
You are solely responsible for the content, accuracy, and use of the information collected through the widget on your website. KwoTit is not responsible for any claims, liabilities, or damages arising from the use of the widget on your website.
KwoTit enables businesses to generate payment links and accept payments from their customers through Paystack, a licensed third-party payment processor. KwoTit does not process, hold, custody, or have access to any funds transferred between you and your customers. All payments made through a KwoTit-generated payment link are processed and settled directly by Paystack, in accordance with Paystack's own terms of service and settlement schedule.
KwoTit is not a bank, payment processor, or escrow service, and does not guarantee, insure, or take responsibility for:
You are solely responsible for resolving any payment disputes with your customers and with Paystack directly. KwoTit's role is limited to providing the technical tools (payment links, invoice tracking) that facilitate the transaction — we are not a party to the underlying sale between you and your customer.
Subscription and plan-upgrade prices are displayed and quoted in advance, but the amount you are actually charged is converted to Ghana Cedis (GHS) before payment is submitted to Paystack. This conversion uses exchange rate data obtained from a third-party currency exchange rate API and is refreshed periodically; it is not guaranteed to match the real-time interbank rate, the rate applied by your card issuer or bank, or the rate Paystack itself may use for any related settlement.
By confirming payment, you accept the GHS amount shown at checkout as the final and binding price for that transaction. KwoTit is not responsible for, and will not compensate for, any difference between the converted GHS amount charged and any other exchange rate you may separately observe (including on your bank or card statement), nor for exchange rate fluctuations occurring between the time a price is displayed and the time payment is completed. We recommend reviewing the exact GHS amount shown at checkout before confirming any payment.
KwoTit owns and retains all rights, title, and interest in and to the platform, including all software, code, algorithms, designs, templates, documentation, and related intellectual property. You may not copy, modify, reverse-engineer, decompile, or create derivative works of the platform or any part of it, except as expressly permitted by these Terms.
You retain ownership of any data, content, or information you create through the platform, including Lead Forms, questions, pricing, customer information, and lead data. By using the platform, you grant KwoTit a non-exclusive, worldwide, royalty-free license to store, process, and display your content solely as necessary to provide the Services.
The embed code and widget scripts provided by KwoTit are proprietary and may only be used as part of your active KwoTit account. You may not distribute, sublicense, or resell the widget or embed code to third parties. Embedding the widget on your website for your own business purposes is permitted, provided you comply with these Terms.
KwoTit may collect and analyze usage data, anonymized statistics, and aggregated information to improve the platform, develop new features, and understand user behavior. This data will not identify you or your customers personally and may be shared with third parties in aggregated, anonymized form.
As a business using KwoTit, you may collect personal information from your customers through the widget (such as names, email addresses, phone numbers, and project details). You are responsible for complying with all applicable data protection and privacy laws regarding the collection, storage, and use of your customers' information.
KwoTit processes customer data on your behalf as a data processor. We process data only as necessary to provide the platform and as directed by you. We implement reasonable security measures to protect customer data. However, no method of transmission or storage is 100% secure, and KwoTit cannot guarantee absolute security.
KwoTit may retain anonymized and aggregated data derived from your use of the platform for analytical and improvement purposes, but we will not retain or use your customers' personal information for our own purposes without your consent.
If you are subject to the GDPR or other privacy regulations, you agree to obtain any necessary consents from your customers before collecting their information through the KwoTit widget.
You agree not to use our platform to:
KwoTit reserves the right to suspend or terminate your account if we reasonably believe you have violated this Acceptable Use policy, without obligation to refund any amounts paid.
We work to keep the platform available and functioning correctly, but we do not guarantee uninterrupted, error-free, or continuous availability. We may suspend, restrict, or modify any part of the platform — including for maintenance, upgrades, security reasons, or due to factors outside our control — without liability for any resulting loss or inconvenience.
Support is provided through our Help Center, documentation, and email. Pro and Lifetime subscribers receive priority support with faster response times. Response times are estimates only and are not guaranteed.
Our platform and services are provided on an "as is" and "as available" basis. While we take care to deliver quality service, we do not guarantee that the platform will be error-free, uninterrupted, or fit for any particular purpose beyond what is explicitly described in these Terms.
To the maximum extent permitted by applicable law, KwoTit disclaims all other warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except where such warranties cannot be lawfully excluded.
KwoTit is not responsible for the accuracy, completeness, or reliability of any quotes, estimates, or calculations generated through the platform. You are responsible for reviewing and verifying any leadbefore presenting it to your customers.
To the maximum extent permitted by applicable law, KwoTit's total liability for any claim arising from or related to the platform or services shall not exceed the total amount you paid to KwoTit in the twelve (12) months preceding the claim, or GHS 500.00, whichever is greater.
KwoTit will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or business opportunities, even if we have been advised of the possibility of such damages.
KwoTit is not responsible for any decisions made or actions taken by you or your customers based on quotes or estimates generated through the platform.
You agree to indemnify and hold harmless KwoTit, its founder, employees, contractors, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to: (a) your use or misuse of the platform; (b) your violation of these Terms; (c) your violation of any law or the rights of a third party; (d) any content, data, or materials you provide to or through the platform; or (e) any quotes, estimates, or representations made by you to your customers using the platform.
Either party may terminate this agreement by providing written notice to the other. Upon termination, your access to the platform and dashboard will be disabled, and any data stored on the platform may be deleted. No refunds will be issued for unused subscription periods.
KwoTit may suspend or terminate your access to the platform if: you breach these Terms; payments are overdue; you engage in abusive, fraudulent, or illegal conduct; or continuing to provide Services would expose KwoTit to legal or reputational risk.
Upon termination, you must cease using the platform and widgets immediately, and remove all KwoTit embed codes from your websites.
Our platform relies on and integrates with third-party services, including but not limited to Supabase for database and authentication, Paystack for payment processing, and hosting providers. These third parties operate under their own terms and privacy policies, which we encourage you to review.
KwoTit is not responsible for outages, errors, policy changes, or actions taken by these third-party platforms, although we will make reasonable efforts to inform you of any significant impact on your use of the platform.
If a dispute arises between you and KwoTit relating to these Terms or the platform, both parties agree to first attempt to resolve the matter informally through good-faith discussion.
If the dispute cannot be resolved informally within a reasonable period, it will be subject to the exclusive jurisdiction of the courts of Ghana, unless the parties agree in writing to an alternative dispute resolution method, such as mediation or arbitration.
These Terms, and any dispute arising from or related to them or the platform, are governed by and interpreted in accordance with the laws of Ghana, without regard to conflict-of-law principles.
If any provision of these Terms is found by a court or other authority to be invalid, illegal, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions of these Terms will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and KwoTit regarding the platform, and supersede any prior discussions, understandings, or agreements, whether written or verbal.
